1. DOCUMENTATION OF INCOME FOR WAGES: PAY STUBS

IT IS IMPERATIVE to provide to attorney ALL the CORRECT pay stubs. Bankruptcy rules are very specific about how the Current Monthly Income is calculated. Since ability or inability to repay debt depends on earned income, providing only debt information to attorney will not assist attorney in evaluating the case. Sending some or incorrect pay stubs also may not be helpful.

Avoid Common Mistakes: PAY PERIOD IS NOT RELEVANT. Look at CHECK ISSUE DATE or CHECK PAYMENT DATE to find the appropriate pay stub(s). If you have multiple sources of wages, be sure to include all sources. Include spouse wages, even if spouse not filing.

If you cannot find your pay stubs or obtain prints online, ask your employer to provide you with duplicates (might be best to ask for all six month's worth to avoid having to ask for any other stubs that may be needed if your case is not filed in a different month).
